Two partners of Rajyog Developers get 3 months' jail

Pune: Two partners of Rajyog Developers have been sentenced to three months imprisonment by the District Consumer Forum for not complying with its order (passed last year) directing them to form a co-operative housing society and provide amenities in a flat as per their brochure. They were also ordered to pay fine of Rs 10,000.

Bhalchandra Vijay Marathe and his wife Yogini, residents of Hingane, Sinhagad Road, had moved the forum against Pratap Gangadhar Kotwal and Ashok Baburao Deshmukh, both partners of Rajyog Developers, Sangamner in Bhor taluka of Pune district. 

In his complaint, Marathe stated that the accused builders have not complied with the forum's order except the payment of Rs 10,000 towards compensation.

Kotwal deposed that he completed the work of lights, compound, entrance door and the servant's quarter. However, in the cross-examination, he admitted that he has not completed the work of fencing, road, jogging track, water tank and electric line up to plot no.16 of the applicants.

The forum observed, "The order has been passed on 12-8-16. Much time has lapsed but the accused have not complied the order. There are no satisfactory reasons forthcoming for the lapses on the part of the accused in complying with the order."

The forum found the builders guilty of an offence under Section 27 (penalties) of the Consumer Protection Act.
