Police to inform HC about Desai’s procession

The police said 150 of his supporters had gathered near the Yerwada jail and after Desai came out, the procession began. Desai was waving at the people by standing in the sunroof of a car. His supporters were carrying saffron flags and raised slogans.

PUNE: The police on Sunday said they are seeking legal opinion and will inform the court about Saturday’s procession in support of Hindu Rashtra Sena Founder President Dhananjay Desai after he was released from the Yerwada Central Jail. 

The Bombay High Court granted him bail on January 17, after he had given undertakings about various conditions. Desai was lodged in the jail for the last five years in connection with murder of engineer Mohsin Shaikh during the 2014 communal riots in Hadapsar. 

Meanwhile, Yerwada police have registered a case against Desai’s supporters for organising a procession without requisite permission. 

The police said 150 of his supporters had gathered near the Yerwada jail and after Desai came out, the procession began. Desai was waving at the people by standing in the sunroof of a car. His supporters were carrying saffron flags and raised slogans. 

Senior Police Inspector Dinkar Mohite, in-charge of Yerwada police station, said, “We have identified some persons. Investigation is on to identify others.”

The police said legal opinion has been sought as prima facie Desai violated the bail conditions. 

Mohsin Mohamamed Sadik Shaikh, a native of Solapur, resided in Hadapsar. On June 2, 2014, while returning from offering prayers at masjid, he was chased by some people who are allegedly shouting communal charged slogans. 

About 20 boys came on 7 to 8 motor cycle and followed him and his friend. 

They assaulted Mohsin, while his friend managed to escape. Mohsin was later rushed to a hospital where he was declared dead on arrival. 

Later, HRS members and Desai were arrested.

VIOLATION OF FOLLOWING BAIL UNDERTAKINGS?
- Till conclusion of trial  pending before the Sessions Court,  Pune, the applicant (Desai) shall not in any manner whatsoever involve in any public/ political activities related to or organised at the behest of Hindu Rashtra Sena or even otherwise.
- ”Shall restrain in every manner whatsoever my party workers, activists or my followers from publishing any hoardings/banner depicting my pictures/posters or for that matter any activity pertaining to my organisation namely Hindu Rashtra Sena organisation till the conclusion of trial.”
