Pay Rs 23.38L relief to mishap victim’s family, rules MACT

The deceased, Santosh Borade’s wife Usha (32), daughter Pallavi (13), son Vaibhav (11) and mother Padmini Maruti Borade (60), all residents of Uruli Kanchan, had filed a petition against tempo owner Bharat Gulabrao Bamane of Wagholi and Shriram General Insurance Co. Ltd, Jaipur. The accident took place on Koregaon Mul Road, Uruli Kanchan, around 8.30 pm on May 28, 2014

Pune: The district Motor Accident Claim Tribunal (MACT) has ordered a tempo owner and an insurance company to pay Rs 23.38 lakh to family members of a man who was killed in an accident.

The deceased, Santosh Borade’s wife Usha (32), daughter Pallavi (13), son Vaibhav (11) and mother Padmini Maruti Borade (60), all residents of Uruli Kanchan, had filed a petition against tempo owner Bharat Gulabrao Bamane of Wagholi and Shriram General Insurance Co. Ltd, Jaipur. The accident took place on Koregaon Mul Road, Uruli Kanchan, around 8.30 pm on May 28, 2014.  

Borade worked with M/s. Gholap Dairy Farm and earned Rs 18,000 per month.  He used to collect milk.

As per the petition, the deceased Borade (38) was going home on a motorcycle with his wife. They were returning home at Koregaon Road when the tempo came from opposite direction at high speed and hit the motorcycle and Borade and his wife sustained injuries. They were rushed to a hospital in Hadapsar, where Borade succumbed to his injuries on the same day. Later, an FIR was registered against tempo driver Bapu Shinde for causing death due to negligence and rash driving. During the hearing, the insurance company’s lawyer argued that ‘the accident took place at the middle of the road and it suggests that motorcycle driver has crossed his limits and he came towards his right hand side.’

However, the MACT held the tempo driver responsible for the accident and ordered compensation of Rs 23.38 lakh with nine per cent interest since filling of the petition in August 2014.
