Pune: The district consumer forum has ordered Sony India Pvt Ltd and its dealers to replace a Sony Xperia M5 phone, worth Rs 30,800, or refund the amount with interest as the phone was found to be defective within two months of purchase.
The forum also asked them to pay compensation of Rs 8,000 to the complainant Rojo John of Pimpri. He moved the forum against the manufacturer, Sony India Pvt Ltd, its service centre Chaitanya Electronics in Chinchwad, and authorised dealer Deepak Communications, Pimpri.
He had purchased the phone on November 29, 2015. However, within two months, there were defects in the phone. He made several rounds of the service centres but the phone was not repaired properly. There were problems with the battery, touch screen and the phone used to shut down. He even complained to the manufacturer to replace the phone and other accessories but in vain.
After several reminders, the manufacturer agreed to change the phone but refused to give warranty, charger and manual. John didn’t accept the offer and asked for a refund, which the company refused. Since October 2016, the phone is in the possession of the service centre and he could not use it. He filed the complaint before the consumer forum in January this year.
In its defence, the opposite parties contended that there was no deficiency in service on their part. “When he had brought the phone on March 23, 2016, it was found that the phone had auto switch off issue, which was resolved and the phone was given back and also the battery was changed. Later, he complained of touch screen problem, which was also solved. He again complained of defects and we suggested to replace the phone but he had put several conditions. Therefore, we could not change the phone,” the opposite parties submitted before the forum.
However, the forum held them guilty of deficiency in service and ordered them to either replace the phone with required accessories and give warranty card, or refund the amount with 8 per cent interest since November 29, 2016.
