Builder fails to follow consumer court order, gets 1 month jail

PUNE: Builder Ramesh Kavediya of Sambhav Royal Developers, Camp, was sentenced to one-month imprisonment for not complying with District Consumer Forum order regarding providing amenities in a building as promised and pay Rs 50,000 compensation in 2013. 

The forum comprising President MK Walchale, and Members SJ Dunakhe and SK Pacharne found him guilty of offence under section 27 (penalties) of the Consumer Protection Act. The forum also imposed a fine of Rs 5,000 on him on Wednesday.

The forum ordered him to provide the amenities as well as pay Rs 50,000 as compensation. But he failed to do so. Therefore, the society members again moved the forum in 2014 for execution of the order.

The builder submitted to the forum that he had complied with the order but failed to submit evidence. 

“There is no resolution by the society that the chairman and the secretary are authorised to file this application. I had executed the sale deeds to the purchasers of row houses of the project. Execution of conveyance deed, therefore, is not possible,” he submitted through a lawyer. 

However, the society members pointed out that he failed to comply with the earlier order and the forum accepted their plea and convicted the builder.
